Il s\u2019av\u00e8re que toutes les situations de ch\u00f4mage ne donnent pas droit \u00e0 des allocations de ch\u00f4mage. Outre le licenciement collectif et la cessation de travail, vous pouvez \u00e9galement b\u00e9n\u00e9ficier<br \/>\nallocation de ch\u00f4mage en cas de rupture conventionnelle du contrat de travail pour renforcer les qualifications et la capacit\u00e9 technique des entreprises.<\/p>\n<div>\n<p>Ce type de rupture du contrat de travail, pr\u00e9vu \u00e0 l&#039;article 10-A du DL n\u00b0 220\/2006 du 3 novembre, peut intervenir en cas de gr\u00e9 \u00e0 gr\u00e9, \u00e0 condition qu&#039;il n&#039;existe pas de situations impliquant une diminution du niveau d&#039;emploi, mais il y a d&#039;abord de nouvelles embauches en vue de renforcer les qualifications et les capacit\u00e9s techniques des entreprises. En d&#039;autres termes, l&#039;employeur parvient \u00e0 un accord avec le salari\u00e9 concernant son licenciement, mais, en \u00e9change, il devra pourvoir son poste par une nouvelle recrue poss\u00e9dant un niveau de formation identique ou sup\u00e9rieur.<\/p>\n<p>Cette solution juridique comporte des avantages et des inconv\u00e9nients. Elle sera avantageuse dans les cas o\u00f9 la rupture du contrat de travail ne peut s&#039;inscrire dans une situation de licenciement collectif, dans les cas o\u00f9 il n&#039;existe pas de juste motif de licenciement ou encore dans les cas o\u00f9 l&#039;employeur n&#039;a pas l&#039;intention de voir le poste dispara\u00eetre. Ici, lors de l&#039;accord de rupture, l&#039;employeur se limitera au paiement de l&#039;indemnit\u00e9 compensatoire convenue.<\/p>\n<p>D&#039;autre part, cette solution impliquera la prise en charge d&#039;obligations l\u00e9gales pour l&#039;employeur, qui sera oblig\u00e9 de respecter certaines exigences afin que l&#039;accord conclu ne soit pas consid\u00e9r\u00e9 comme une violation d\u00e9lib\u00e9r\u00e9e, ce qui pourrait conduire l&#039;employeur \u00e0 \u00eatre oblig\u00e9 au S\u00e9curit\u00e9 Prestation sociale pour la p\u00e9riode pendant laquelle l&#039;allocation de ch\u00f4mage initiale est accord\u00e9e.<\/p>\n<p>Ainsi, conform\u00e9ment au paragraphe 2 de l&#039;article 10.\u00ba-A du DL pr\u00e9cit\u00e9, si l&#039;employeur entend conclure ce type d&#039;accord, il devra embaucher, avant la fin du mois suivant la rupture du contrat de travail, un travailleur sous contrat \u00e0 dur\u00e9e ind\u00e9termin\u00e9e \u00e0 temps plein pour occuper le poste de travail susmentionn\u00e9, qui doit n\u00e9cessairement correspondre \u00e0 l&#039;exercice d&#039;une activit\u00e9 de complexit\u00e9 technique, d&#039;un degr\u00e9 \u00e9lev\u00e9 de responsabilit\u00e9 ou qui pr\u00e9suppose une qualification particuli\u00e8re. Il convient de noter que le paragraphe 3 du m\u00eame article pr\u00e9voit que les services de s\u00e9curit\u00e9 sociale peuvent informer le service comp\u00e9tent en mati\u00e8re d&#039;inspection du minist\u00e8re charg\u00e9 du domaine du travail, lorsqu&#039;ils d\u00e9tectent ou soup\u00e7onnent un non-respect l\u00e9gal des dispositions de l&#039;article 10-A. du DL n\u00b0 220\/2006.<\/p>\n<p>Il est \u00e9galement important de noter que l&#039;octroi des allocations de ch\u00f4mage est soumis non seulement au respect des obligations inh\u00e9rentes \u00e0 l&#039;employeur, mais \u00e9galement au respect exhaustif et cumulatif des exigences l\u00e9gales par le travailleur. En ce sens, pour avoir droit aux allocations de ch\u00f4mage, le travailleur doit, par exemple, r\u00e9sider au Portugal, avoir occup\u00e9 un emploi avec un contrat de travail et \u00eatre devenu au ch\u00f4mage pour des raisons ind\u00e9pendantes de sa volont\u00e9 (ch\u00f4mage involontaire), avoir cotis\u00e9 aux cotisations sociales.
