Autrement dit, dans le cas o\u00f9 le propri\u00e9taire du local lou\u00e9 envisage de le vendre, le locataire b\u00e9n\u00e9ficie d&#039;un droit de pr\u00e9f\u00e9rence dans cette transaction, et il en va de m\u00eame en cas de paiement.<\/p>\n<p>Dans ces termes, une communication doit \u00eatre faite par le propri\u00e9taire du bien au locataire, dans laquelle les soi-disant \u00ab \u00e9l\u00e9ments essentiels \u00bb, le projet de vente et les clauses du contrat doivent \u00eatre transmis, afin que la communication pour l&#039;exercice du droit de pr\u00e9f\u00e9rence soit consid\u00e9r\u00e9e comme valable.<\/p>\n<p>Une situation particuli\u00e8re se pr\u00e9sente lorsque le propri\u00e9taire a l&#039;intention de vendre les locaux lou\u00e9s avec d&#039;autres biens immobiliers. Lorsque cela se produit, le propri\u00e9taire doit \u00e9galement communiquer au locataire le prix attribu\u00e9 au bien lou\u00e9, ainsi que les autres valeurs attribu\u00e9es aux biens qu&#039;il entend vendre ensemble.<\/p>\n<p>Dans ce cas, le bailleur doit faire valoir que la vente s\u00e9par\u00e9e lui cause une perte sensible, en en d\u00e9montrant, sous peine de ne pouvoir exiger la vente en commun de tous les biens.<\/p>\n<p>Le droit de pr\u00e9f\u00e9rence du locataire est un droit de pr\u00e9f\u00e9rence l\u00e9gal et un droit potestatif dont l&#039;exercice implique que le pr\u00e9f\u00e9rant puisse participer \u00e0 l&#039;entreprise aux conditions dans lesquelles le propri\u00e9taire du bien a l&#039;intention de le vendre \u00e0 un tiers. .<\/p>\n<p>En cette mati\u00e8re, il est important d&#039;\u00e9tablir une barri\u00e8re entre les r\u00e8gles en vigueur avant et apr\u00e8s la publication de la loi n\u00b0 64\/2018 du 29 octobre 2018 2 , dans la mesure o\u00f9 la loi susmentionn\u00e9e a modifi\u00e9 l&#039;article 1091 du CC , concernant le droit de pr\u00e9emption. des locataires dans l&#039;achat et la vente des locaux lou\u00e9s.<\/p>\n<p>Dans l&#039;ancien r\u00e9gime, la loi fixait un d\u00e9lai de huit jours au locataire pour exercer son droit de pr\u00e9f\u00e9rence. Dans ce d\u00e9lai, non seulement doit avoir lieu la communication de l&#039;intention d&#039;exercer le droit, mais \u00e9galement l&#039;arriv\u00e9e de cette m\u00eame communication au propri\u00e9taire.<\/p>\n<hr \/>\n<p>1 Ci-apr\u00e8s, CC.<br \/>\n2 Ci-apr\u00e8s, Loi n\u00b0 64\/2018.<\/p>\n<p>Actuellement, la loi pr\u00e9voit un d\u00e9lai de trente jours \u00e0 compter de la r\u00e9ception de la communication du bailleur, pour que le locataire, s&#039;il le souhaite, exerce son droit de pr\u00e9f\u00e9rence. Sous l&#039;ancien r\u00e9gime, le locataire aurait un droit de pr\u00e9emption sur l&#039;achat et la vente ou la donation conform\u00e9ment \u00e0 l&#039;emplacement lou\u00e9 il y a trois ans. Conform\u00e9ment aux modifications introduites par la loi n\u00b0 64\/2018, il existe un droit de pr\u00e9f\u00e9rence pour tout locataire d&#039;un immeuble urbain, dans l&#039;achat et la vente ou la donation conform\u00e9ment \u00e0 l&#039;emplacement lou\u00e9 depuis plus de deux ans. Les modifications apport\u00e9es par la loi n\u00b0 64\/2018 facilitent \u00e9videmment l&#039;exercice r\u00e9el du droit de pr\u00e9f\u00e9rence par les locataires.<\/p>\n<p>Concernant les immeubles lou\u00e9s qui ne sont pas soumis au r\u00e9gime horizontal de propri\u00e9t\u00e9 3 , la loi n\u00b0 64\/2018 a introduit de nouvelles r\u00e8gles. Lorsqu&#039;il s&#039;agit d&#039;un contrat de bail \u00e0 usage d&#039;habitation, le locataire d&#039;une partie de l&#039;immeuble b\u00e9n\u00e9ficie d\u00e9sormais d&#039;un droit de pr\u00e9f\u00e9rence dans les m\u00eames conditions que ceux pr\u00e9vus pour le locataire d&#039;une fraction ind\u00e9pendante (article 1091, n\u00b0 8 du CC).<\/p>\n<p>La Cour Constitutionnelle a d\u00e9clar\u00e9, avec force obligatoire g\u00e9n\u00e9rale, l&#039;inconstitutionnalit\u00e9 de la r\u00e8gle contenue au n\u00b0 8 de l&#039;article 1091 du CP, telle que modifi\u00e9e par la loi n\u00b0 64\/2018 4 , pour violation du n\u00b0 1 de l&#039;article 62. \u00ba 5 , c&#039;est-\u00e0-dire le droit de propri\u00e9t\u00e9, en liaison avec le paragraphe 2 de l&#039;article 18.\u00ba de la Constitution de la R\u00e9publique portugaise 6 , dans la mesure o\u00f9 il limitait excessivement le<br \/>\ndroit de transf\u00e9rer des propri\u00e9t\u00e9s de leur vivant, ce qui finit par ne pas atteindre l&#039;objectif vis\u00e9, \u00e0 savoir faciliter le processus d&#039;acc\u00e8s \u00e0 leur propre logement pour les locataires.<\/p>\n<p>La Cour constitutionnelle a consid\u00e9r\u00e9 qu&#039;il s&#039;agissait d&#039;une norme restrictive \u00e0 plusieurs niveaux. En ce qui concerne le propri\u00e9taire, il ne pouvait ainsi disposer librement de ses biens, et la Cour constitutionnelle a consid\u00e9r\u00e9 qu&#039;il s&#039;agissait d&#039;une restriction disproportionn\u00e9e au droit de propri\u00e9t\u00e9. La libert\u00e9 contractuelle des parties a \u00e9t\u00e9 remise en question, puisque la loi n\u00b0 64\/2018 a impos\u00e9 l&#039;existence d&#039;un accord sur l&#039;utilisation de la chose commune, auquel personne n&#039;aurait consenti, laissant ainsi une autonomie priv\u00e9e assez limit\u00e9e. La r\u00e8gle en question aurait \u00e9galement un effet d\u00e9courageant sur les investissements.<\/p>\n<hr \/>\n<\/div>\n<div>\n<p>3 Conform\u00e9ment aux dispositions de l&#039;article 1414 du Code civil, \u00ab les fractions dont est compos\u00e9 un immeuble, dans les conditions de constitution d&#039;unit\u00e9s ind\u00e9pendantes, peuvent appartenir \u00e0 des propri\u00e9taires diff\u00e9rents sous un r\u00e9gime patrimonial horizontal \u00bb et de l&#039;article 1415 du Code civil. Selon le Code civil, \u00ab\u00a0seules les fractions autonomes qui, en plus de constituer des unit\u00e9s ind\u00e9pendantes, sont distinctes et isol\u00e9es les unes des autres, avec leur propre sortie sur une partie commune de l&#039;immeuble ou sur la voie publique, peuvent \u00eatre soumises \u00e0 la propri\u00e9t\u00e9 horizontale\u00a0\u00bb.<br \/>\n4 Arr\u00eat de la Cour Constitutionnelle n\u00b0 299\/2020, Proc\u00e8s n\u00b0 984\/2018, publi\u00e9 le 18 septembre 2022, sur https:\/\/files.dre.pt\/1s\/2020\/09\/18300\/0000600038.pdf .<br \/>\n5 Aux termes de cet article, \u00ab le droit \u00e0 la propri\u00e9t\u00e9 priv\u00e9e et \u00e0 sa transmission pendant la vie ou la mort est garanti \u00e0 chacun, conform\u00e9ment \u00e0 la Constitution \u00bb.<br \/>\n6 Cet article pr\u00e9voit que \u00ab\u00a0la loi ne peut restreindre les droits, libert\u00e9s et libert\u00e9s garantis que dans les cas express\u00e9ment pr\u00e9vus par la Constitution, et les restrictions doivent \u00eatre limit\u00e9es \u00e0 ce qui est n\u00e9cessaire pour sauvegarder d&#039;autres droits ou int\u00e9r\u00eats constitutionnellement prot\u00e9g\u00e9s\u00a0\u00bb.<\/p>\n<p>&nbsp;<\/p>\n<p>La Cour constitutionnelle a \u00e9galement compris que la r\u00e8gle en question violait une juste compensation, car elle pr\u00e9voyait la fixation de la valeur de la fraction en fonction du permillage, et du degr\u00e9 d&#039;\u00e9clairage naturel, du niveau de conservation, des vues, de l&#039;emplacement doit \u00e9galement \u00eatre consid\u00e9r\u00e9. , entre autres.
