{"id":6942,"date":"2023-12-13T02:24:40","date_gmt":"2023-12-13T02:24:40","guid":{"rendered":"https:\/\/mpcp-advogados.com\/?p=6942"},"modified":"2024-09-10T16:56:59","modified_gmt":"2024-09-10T16:56:59","slug":"lhebergement-local-dans-des-unites-destinees-a-lhabitation","status":"publish","type":"post","link":"https:\/\/mpcp-advogados.com\/fr\/lhebergement-local-dans-des-unites-destinees-a-lhabitation\/","title":{"rendered":"H\u00e9bergement local en fractions destin\u00e9es au logement"},"content":{"rendered":"<div id=\"fws_69df5dee6a8d8\"  data-column-margin=\"default\" data-midnight=\"dark\"  class=\"wpb_row vc_row-fluid vc_row\"  style=\"padding-top: 0px; padding-bottom: 0px; \"><div class=\"row-bg-wrap\" data-bg-animation=\"none\" data-bg-overlay=\"false\"><div class=\"inner-wrap\"><div class=\"row-bg viewport-desktop\"  style=\"\"><\/div><\/div><\/div><div class=\"row_col_wrap_12 col span_12 dark left\">\n\t<div  class=\"vc_col-sm-12 wpb_column column_container vc_column_container col no-extra-padding inherit_tablet inherit_phone\"  data-padding-pos=\"all\" data-has-bg-color=\"false\" data-bg-color=\"\" data-bg-opacity=\"1\" data-animation=\"\" data-delay=\"0\" >\n\t\t<div class=\"vc_column-inner\" >\n\t\t\t<div class=\"wpb_wrapper\">\n\t\t\t\t\n<div class=\"wpb_text_column wpb_content_element\" >\n\t<div class=\"wpb_wrapper\">\n\t\t<h3>H\u00e9bergement local en fractions destin\u00e9es au logement \u2013 Arr\u00eat STJ 22\/03\/2022<\/h3>\n<div><\/div>\n<div>\n<p>Afin de d\u00e9terminer si l&#039;utilisation d&#039;une fraction autonome (destin\u00e9e \u00e0 l&#039;habitation) pour exploiter un H\u00e9bergement Local (AL) viole le titre constitutif de la propri\u00e9t\u00e9 horizontale, la Cour Supr\u00eame de Justice a rendu le 22 mars 2022 un arr\u00eat uniformisateur de jurisprudence. cela a \u00e9t\u00e9 consid\u00e9r\u00e9 comme controvers\u00e9 et controvers\u00e9.<\/p>\n<p>Cette d\u00e9cision pr\u00e9cise que \u00ab dans le r\u00e9gime de propri\u00e9t\u00e9 horizontal, l\u2019indication dans le titre constitutif selon laquelle une certaine fraction est destin\u00e9e au logement doit \u00eatre interpr\u00e9t\u00e9e comme signifiant que l\u2019h\u00e9bergement local n\u2019est pas autoris\u00e9 \u00bb.<\/p>\n<p>\u00c0 cet \u00e9gard, il est important de noter qu&#039;aux termes de l&#039;article 1418, n\u00b0 2, a) du Code civil, le titre constitutif d&#039;une fraction autonome contient, entre autres \u00e9l\u00e9ments, une mention du but pour lequel cette fraction est destin\u00e9. Cette fin peut \u00eatre r\u00e9sidentielle ou commerciale, et doit \u00eatre respect\u00e9e comme telle, et il est interdit d&#039;utiliser la fraction \u00e0 une fin autre que celle indiqu\u00e9e au titre constitutif, comme le prescrit l&#039;article 1422, n\u00b0 2, c) du Code civil. Code.<\/p>\n<p>Ainsi, la discussion en question part en r\u00e9alit\u00e9 d&#039;une premi\u00e8re question fondamentale : l&#039;activit\u00e9 d&#039;H\u00e9bergement Local int\u00e8gre-t-elle un acte de commerce ou la notion d&#039;habitat ?<\/p>\n<p>La doctrine et la jurisprudence ne sont pas unanimes sur ce point, les arguments soutenant des interpr\u00e9tations diff\u00e9rentes.<\/p>\n<p>Il a \u00e9t\u00e9 compris dans cet arr\u00eat de la Cour Supr\u00eame de Justice que du point de vue de la destination de la chose et de son environnement socio-\u00e9conomique respectif de copropri\u00e9t\u00e9, une exp\u00e9rience de logement est diff\u00e9rente de son utilisation dans l&#039;H\u00e9bergement Local.<\/p>\n<p>En effet, il convient de noter que dans un H\u00e9bergement Local, il y a une rotation, un caract\u00e8re al\u00e9atoire et une permanence temporaire des utilisateurs, effectivement incompatibles avec ce qui se passe dans une fraction destin\u00e9e au logement, qui comportera toujours un certain degr\u00e9 de certitude, de continuit\u00e9, de s\u00e9curit\u00e9 et de familiarit\u00e9. absolument distinct.<\/p>\n<p>Il n\u2019est pas non plus possible de comparer un utilisateur d\u2019H\u00e9bergement Local \u00e0 un r\u00e9sident d\u2019une unit\u00e9 autonome. Les h\u00e9bergements locaux sont principalement recherch\u00e9s par les personnes en vacances, cherchant \u00e0 se d\u00e9tendre et \u00e0 s&#039;abstraire de leur vie quotidienne, comme le pr\u00e9supposent toutes les vacances. Contrairement \u00e0 un r\u00e9sident normal, il se rend dans son appartement dans le cadre de sa vie quotidienne, dans le cadre de sa routine, \u00e0 la recherche d&#039;un calme et d&#039;une tranquillit\u00e9 souvent incompatibles avec la d\u00e9tente, l&#039;excitation et la f\u00eate des utilisateurs d&#039;un H\u00e9bergement Local.<\/p>\n<p>D&#039;autre part, il est \u00e9galement important de noter que la loi n\u00b0 62\/2018 pr\u00e9voit la possibilit\u00e9 pour l&#039;assembl\u00e9e de copropri\u00e9t\u00e9 de s&#039;opposer, par d\u00e9lib\u00e9ration, \u00e0 l&#039;exercice de l&#039;activit\u00e9 d&#039;h\u00e9bergement local dans des unit\u00e9s autonomes, sur la base de la pratique d&#039;actes qui perturbent. l&#039;usage normal de l&#039;immeuble et les actes qui nuisent au reste des copropri\u00e9taires. Cette d\u00e9lib\u00e9ration pourrait d\u2019ailleurs \u00eatre \u00e0 la base de l\u2019annulation de l\u2019H\u00e9bergement Local par la commune.<\/p>\n<p>Or, \u00e9tant donn\u00e9 que cette protection existe dans la loi n\u00b0 62\/2018, il semble pr\u00e9cis\u00e9ment difficile de comprendre la d\u00e9cision du STJ, une d\u00e9cision bas\u00e9e sur la d\u00e9fense des propri\u00e9taires de copropri\u00e9t\u00e9s, qui en r\u00e9alit\u00e9, comme le pr\u00e9voit la loi, \u00e9taient d\u00e9j\u00e0 prot\u00e9g\u00e9s par cela signifie. L&#039;esprit de la loi n\u00b0 62\/2018 semble en effet r\u00e9sulter de l&#039;intention du l\u00e9gislateur de ne pas interdire compl\u00e8tement et d&#039;embl\u00e9e l&#039;h\u00e9bergement local dans des immeubles sur propri\u00e9t\u00e9 horizontale, en consacrant cependant pour \u00ab contrebalancer \u00bb l&#039;admissibilit\u00e9 des propri\u00e9taires de copropri\u00e9t\u00e9s. &#039; r\u00e9action \u00e0 l&#039;H\u00e9bergement Local dans des circonstances qui leur sont pr\u00e9judiciables.<\/p>\n<p>Il ressort clairement de cet Arr\u00eat\u00e9 qui uniformise la jurisprudence que l&#039;installation d&#039;H\u00e9bergements Locaux dans une fraction autonome qui, conform\u00e9ment au titre constitutif de la propri\u00e9t\u00e9 horizontale et en l&#039;absence d&#039;autres \u00e9l\u00e9ments juridiques, est destin\u00e9e au logement est interdite.<\/p>\n<p>Enfin, il convient de parler de l\u2019applicabilit\u00e9 de cet arr\u00eat. Il convient de noter d&#039;embl\u00e9e que la d\u00e9cision du STJ n&#039;a pas pour effet imm\u00e9diat et direct de modifier la l\u00e9gislation sur l&#039;h\u00e9bergement local, mais elle aura n\u00e9cessairement un impact sur les d\u00e9cisions que les tribunaux prendront en la mati\u00e8re, car une entente diff\u00e9rente de celle expos\u00e9e dans le pr\u00e9sent jugement n\u2019est pas autoris\u00e9e.
